This Privacy Policy applies to MGA Entertainment Australia Pty Ltd and its related bodies corporate (we, us, our) in relation to our Australian operations. It explains how we handle personal information and comply with the requirements of the Privacy Act 1988 (Cth) and other applicable privacy laws (Privacy Laws). This Privacy Policy is subject to any applicable local Privacy Laws.
We recognise the importance of your privacy, and that you have a right to control how your personal information is collected and used.
- Collection of personal information
2.1 We collect personal information from customers (existing and prospective), suppliers, contractors, prospective employees, and consumers and other individuals for various business and other purposes further listed in section Error! Reference source not found. below. In this section, we explain the types of personal information which we collect as well as how we collect this information.
2.2 The types of personal information we collect depends on the circumstances in which the information is collected. They include:
(a) contact details (e.g., name, address, email, phone number);
(b) information about your employment (e.g., place of work, position, authority to transact with us, etc.);
(c) information about your purchases and prior dealings with us or our affiliated companies / related bodies corporate;
(d) records and copies of your correspondence (including email addresses), if you contact us via email or via our online forms, or when you contact us by telephone;
(e) details of your payment information (e.g., payment card, transaction, or financial account information) when you purchase our products, held by our payment gateway provider employing industry standard protections;
(f) employment- and background-related information required as part of a recruitment process;
(g) personal information you provide to us while using our services (e.g., by authorising us to access to your device’s camera, photo album, and microphone);
(h) statistical information regarding the use of our websites, including website users’ IP addresses, browser type, domain names, referring and exit pages and URLs, pages viewed and the order of these page views, and the dates and times of visits;
(i) if you access our website through a mobile device, your devices’ unique device identifier, international mobile equipment identity, mobile equipment identifier, MAC address, devices’ operating system, devices’ physical location (including geolocation, beacon-based location, and GPS location) of your device, your mobile network information, and your mobile device’s advertising ID;
(j) other personal information that we collect about you that we receive from our partners, group members or other third parties to help us correct or supplement our records, improve the quality or personalisation of our services to you, and prevent or detect fraud; and
(k) if you are a vendor or supplier, we may collect information such as a tax form and/or bank account information, which is held by a secure server, to allow us to process payment for services rendered.
2.3 We collect personal information in a range of different ways, including:
(a) through our interactions with you (for example, records of telephone calls, emails, online forms, live chats, SMS messages, or messages you post on our social media pages);
(b) through our websites and online platforms (for example, when you create an account, make a purchase, subscribe to updates, or complete an online form);
(c) through your use of social media platforms where we maintain a presence;
(d) when you place orders for products or services;
(e) when you submit an employment application;
(f) from third party service providers, contractors and business partners who assist us in providing our products and services;
(g) when you request brochures, join a mailing list, enter a promotion or competition, or request to be contacted for further information;
(h) when you make a warranty claim;
(i) when we provide customer service or technical support;
(j) when you respond to surveys, promotions or research conducted by us or on our behalf;
(k) through cookies, pixels, analytics tools and similar technologies when you use our websites or digital services;
(l) from publicly available sources, such as public registers or social media platforms; and
(m) from our related bodies corporate.
2.4 If you do not provide the personal information we request, we may be unable to provide you with our products or services, respond to your enquiries, process transactions, assess your application for employment, or otherwise carry out the purposes for which the information was collected.
2.5 Where practicable, we collect personal information directly from you. If we receive information about you from someone else (for example from someone who supplies goods or services to us), we will take reasonable steps to ensure you are aware that we have collected personal information about you and the circumstances of the collection.
- Use and disclosure of personal information
3.1 At or before the time we collect personal information, or as soon as practicable afterwards, we will take reasonable steps to notify you of the purposes for which the information is collected.
We collect, hold, use and disclose personal information for the primary purpose for which it is collected and for related secondary purposes where you would reasonably expect us to do so, and otherwise as permitted or required by law. These purposes include:

(b) obtaining products, services or information from suppliers and service providers;

3.2 In carrying out our business activities and the purposes described above, we may disclose personal information to our related bodies corporate and to third parties who provide products or services to us or on our behalf.
3.3 These third parties may include providers of customer support services, order fulfilment services, marketing and promotional services, event management services, payment processing services, information technology and hosting services, data storage providers, analytics providers, professional advisers and other business support services.
3.4 We take reasonable steps to ensure that such recipients are subject to appropriate obligations of confidentiality and are required to use personal information only for the purposes of providing services to us or as otherwise permitted by law.
3.5 Additionally, we may disclose personal information to another organisation if:
(a) we believe it is necessary to provide you with a product or service which you have requested, or to otherwise perform a contract with you;
(b) it is reasonably necessary for a purpose related to the primary purpose of collection and you would reasonably expect the use or disclosure;
(c) it is reasonably necessary to prevent or lessen a serious threat to the life, health or safety of any individual, or to public health or safety;
(d) it is reasonably necessary to take appropriate action in relation to suspected unlawful activity or serious misconduct;
(e) it is reasonably necessary to establish, exercise or defend a legal or equitable claim, or to obtain professional advice in connection with such a claim
(f) it occurs in connection with a merger, acquisition, restructuring, sale of assets or other corporate transaction, in which case we will take reasonable steps to ensure the recipient handles the personal information in accordance with applicable privacy laws;
(g) you have provided your consent; or
(a) the use or disclosure is required or authorised by or under an Australian law or a court or tribunal order.
3.6 We will not use or disclose personal information for a purpose other than the primary purpose of collection unless:
(a) you have consented to the use or disclosure;
(b) the use or disclosure is for a secondary purpose that is related to the primary purpose of collection (or, in the case of sensitive information, directly related to the primary purpose) and you would reasonably expect us to use or disclose the information for that secondary purpose; or
(c) the use or disclosure is otherwise permitted or required by or under the Privacy Laws.
- Service providers
4.1 Like most large organisations, we use a range of service providers to help us maximise the quality and efficiency of our services and our business operations. This means that individuals and organisations outside of our organisation, such as E-commerce/fulfillment providers, payment processors, email/SMS marketing platforms, digital advertising partners, payroll processors, benefits administrators, background check vendors, HRIS/HCM platform, CRM platforms, trade show/event platforms, contract management systems and mail houses, will sometimes have access to personal information held by us and may use it on behalf of us. We require our service providers to adhere to strict privacy guidelines and not to keep this information or use it for any unauthorised purposes.
- Disclosure of information outside the jurisdiction of collection
5.1 We may disclose personal information outside of the jurisdiction from which it was collected. In the conduct of our business, we transfer to, hold, or access information personal information from various countries including Australia, the United States, and Hong Kong. The Privacy Laws of those countries may not provide the same level of protection as the Privacy Laws of the country from which the personal information was collected. However, this does not change our commitments to safeguard your privacy and we will comply with all applicable laws relating to the cross-border data disclosure.
- Direct marketing
6.1 Like most businesses marketing is important to our business’ success. We, therefore, from time to time, send marketing materials to current or prospective customers or specifiers. We only do so in accordance with applicable laws or with your prior consent.
6.2 If you are receiving promotional information from us and do not wish to receive this information any longer, please contact us direct at privacy@mgae.com,and ask to be removed from our mailing lists, or use the unsubscribe facilities included in our marketing communications.
- Our website privacy practices
7.1 We sometimes use cookie technology on our websites to provide information and services to website visitors. Cookies are pieces of information that a website transfers to your computer’s hard disk for record keeping purposes and are a necessary part of facilitating online transactions. Most web browsers are set to accept cookies. Cookies are useful to estimate our number of members and determine overall traffic patterns through our websites.
7.2 If you do not wish to receive any cookies, you may set your browser to refuse cookies. This may mean you will not be able to take full advantage of the services on the website.

8.1 Our websites may contain links to third party websites. These linked sites are not under our control and we are not responsible for the content of those sites nor are those sites subject to our Privacy Policy. Before disclosing your personal information on any other website, we recommend that you examine the terms and conditions and privacy policy of the relevant site. We are not responsible for any practices on linked websites that might breach your privacy.
- Employee information
9.1 This Privacy Policy does not apply to the handling of information about employees by us. For information about our practices relating to employee information please contact hrla@mgae.com.
- Recruitment
10.1 If you send us an application for a position, we will collect and use your personal information to assess your application and to manage the recruitment process.
10.2 Your personal information may be disclosed to our related bodies corporate and to third-party service providers who assist us with recruitment and human resources functions, such as recruitment agencies, background screening providers, references you nominate, and information technology service providers.
10.3 We may also use and disclose your personal information to verify your qualifications, experience, work rights and references, and to comply with our legal obligations.
10.4 If you do not provide the personal information requested, we may be unable to properly consider your application.
10.5 You may also be asked whether you agree to your personal information being provided to our related bodies corporate for other positions relevant to your qualifications and experience.
- Accessing and correcting the information we keep about you
11.1 You may request access to the personal information we hold about you by contacting us at privacy@mgae.com. We will respond to your request within a reasonable period (usually within 30 days). Where reasonable and practicable, we will provide access in the manner you request. We may charge a reasonable fee to cover the costs of providing access (but not for making the request).
11.2 If you believe that personal information we hold about you is inaccurate, out-of-date, incomplete, irrelevant or misleading, you may request that we correct it. We will take reasonable steps to correct the information within a reasonable period.
11.3 You may also request that we delete your personal information. We will take reasonable steps to destroy or de-identify personal information where we are no longer required to retain it for a lawful purpose, subject to any legal, regulatory or contractual obligations to retain the information.
11.4 In some circumstances, we may refuse to provide access to or correct personal information as permitted by the Privacy Laws. If we refuse your request, we will provide you with written reasons for the decision (except where it would be unreasonable to do so) and information about the mechanisms available to you to complain about the decision.
- How we hold and secure your personal information
12.1 We may hold personal information we have collected in paper and/or electronic form. We will take reasonable steps to secure personal information we hold about you, and to protect it from misuse, interference and loss and from unauthorised access, modification and disclosure. We require our personnel, third party data processors and other third-party service providers who we permit to access personal information we hold to handle that information responsibly and in accordance with applicable Privacy Laws.
- Retention of information
13.1 We will take reasonable steps to destroy or permanently de-identify personal information when it is no longer needed for any purpose for which it may be used or disclosed under the Privacy Laws, unless we are required or authorised by law (or a court or tribunal order) to retain the information.

14.2 In most cases we will ask that you put your request in writing to us. We will investigate your complaint and will use reasonable endeavours to respond to you in writing within a reasonable time of receiving the written complaint. If we fail to respond to your complaint within a reasonable time of receiving it in writing or if you are dissatisfied with the response that you receive from us, you may have the right, depending on the jurisdiction, to make a complaint to the applicable regulator.
- Future changes
15.1 We operate in a dynamic business environment. Over time, aspects of our business may change as we respond to changing market conditions. This may require our policies to be reviewed and revised. We reserve the right to change this Privacy Policy at any time and notify you by posting an updated version of the policy on our website.
15.2 If at any point we decide to use or disclose personal information for a purpose that is materially different from the purpose for which it was collected, we will notify individuals to whom that information relates by email or via a notice on our website, and where necessary we will seek the prior consent of those individuals.
